Terms of Service
These Terms of Service ("Terms") govern your use of mailacard.ca and the postcard services provided by Mail A Card ("we", "us", or "our"), based in Goderich, Ontario, Canada. By placing an order or using this website, you agree to be bound by these Terms. If you do not agree, please do not use our service.
1. The Service
Mail A Card is an online postcard creation and mailing service. You provide a photo, a message, and a recipient's Canadian mailing address. We print your postcard on physical card stock and mail it via Canada Post on your behalf.
We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.
2. Eligibility
You must be at least 18 years of age to place an order. By using the service you represent that you meet this requirement. If you are placing an order on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Orders
An order is created when you complete the card builder form and submit it successfully. You will receive a confirmation email with your order number. Your order is not confirmed for production until payment has been received in full.
We reserve the right to refuse or cancel any order at our sole discretion, including if we believe the content violates these Terms or applicable law.
4. Pricing and Payment
Prices are listed in Canadian dollars (CAD) and are subject to change without notice. The price displayed at the time you submit your order is the price you will be charged.
Payment is processed securely by Stripe, Inc.. We accept Visa, Mastercard, American Express, and other cards supported by Stripe. By providing your payment information you authorise us to charge the total order amount.
All prices are exclusive of applicable taxes. Any taxes owing (such as HST/GST) will be displayed at checkout.
5. Content Guidelines
You are solely responsible for the content of your postcard, including the image you upload and the message you write. You must not submit content that:
- Is illegal, defamatory, harassing, threatening, or abusive.
- Infringes any copyright, trade-mark, or other intellectual property right belonging to any third party.
- Contains nudity, sexually explicit material, or graphic violence.
- Promotes hatred, discrimination, or harm against any individual or group.
- Is misleading or constitutes unsolicited commercial communication (spam).
We reserve the right to refuse to print any order containing prohibited content and to cancel such orders without refund.
6. Intellectual Property
You retain ownership of the photos and content you upload. By submitting an order you grant Mail A Card a limited, non-exclusive licence to use your content solely for the purpose of printing and mailing your postcard.
All other content on this website — including logos, graphics, text, and code — is the property of Mail A Card and may not be reproduced without our written permission.
7. Delivery
Postcards are mailed via Canada Post. Delivery timeframes are estimates only and are not guaranteed. Mail A Card is not responsible for:
- Delays caused by Canada Post or other carriers.
- Non-delivery due to an incorrect or incomplete address provided by you.
- Loss, damage, or delays caused by events outside our control (force majeure).
It is your responsibility to ensure the recipient's address is accurate and complete before submitting your order.
8. Refunds and Cancellations
Once an order has been submitted and payment received, production begins promptly. Orders cannot be cancelled or refunded once they have been queued for printing.
If you believe there is an error on our part — such as a printing defect or a card mailed to the wrong address due to our mistake — please contact us at sales@mailacard.ca within 14 days of the order being marked as mailed. We will review your case and, at our discretion, may offer a reprint or store credit.
We do not offer refunds for: change of mind, Canada Post delivery delays, or incorrect addresses provided by you.
9. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Mail A Card and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of — or inability to use — the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Mail A Card and its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms.
12. Privacy
Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Changes to These Terms
We may update these Terms at any time by posting the revised version on this page with an updated effective date. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
